We aim to provide a fair, secure, and reliable experience for all customers while protecting our business and community from fraud, abuse, and misuse.

2. Product Information and Availability
We make reasonable efforts to display product descriptions, images, pricing, and availability as accurately as possible. However, we do not guarantee that product descriptions, images, colors, finishes, pricing, or other content on the website will always be complete, current, error-free, or exactly match how a product appears on every screen or device.
Minor differences in color, tone, finish, scale, or appearance may occur due to photography, lighting, screen settings, manufacturing variation, or normal product variation.

All orders are subject to review, acceptance, and availability. 5. Shipping, Delivery, and Expedited Fulfilment
Shipping times, processing times, and delivery timeframes are provided in our Shipping Policy and are estimates only unless Amariell expressly provides a written guarantee stating otherwise.
Expedited Fulfilment Included means that an eligible order is placed into a priority processing queue. It does not guarantee same-day processing, shipment by a particular date, faster carrier transportation, or delivery by a particular date.
All expedited fulfilment, processing, shipping, and delivery timeframes are estimates and are not guaranteed. Timeframes may be affected by inventory availability, order verification, order volume, weekends, holidays, customs procedures, weather, carrier disruptions, incorrect shipping information, fulfillment delays, or other circumstances outside Amariell’s reasonable control.
A missed estimated timeframe does not automatically create a right to a refund, cancellation, replacement, reimbursement, shipping-fee refund, or other compensation, except where required by applicable law.
Amariell is not responsible for carrier delays, customs delays, weather-related delays, local delivery disruptions, failed delivery attempts, incorrect address information provided by the customer, or other events outside our reasonable control.
Shipping-related issues, including delivery disputes, lost packages, damaged packages, and marked-as-delivered claims, are reviewed according to our Shipping Policy, Returns & Refund Policy, and Lifetime Order & Shipping Protection terms where applicable.
By placing an order, you acknowledge and agree to the shipping and fulfilment terms posted on our website.
6. Returns, Refunds, and Exchanges
All returns, refunds, replacements, exchanges, and related matters are governed by our Returns & Refund Policy.
Nothing on this website should be interpreted as creating a right to a return, refund, replacement, or exchange except as expressly stated in our posted policies or where required by applicable law.
7. Lifetime Order & Shipping Protection
Lifetime Order & Shipping Protection applies only when purchased or expressly included with an eligible order. It is limited to the original purchaser and is subject to the eligibility requirements, exclusions, evidence requirements, claim deadlines, and available resolutions stated in our Shipping Policy, Returns & Refund Policy, and applicable protection terms.
The shipping protection portion applies only to qualifying and verified shipping incidents covered under the applicable protection terms.
The product protection portion is a Limited Lifetime Product Warranty covering qualifying and verified manufacturing defects during the reasonable usable life of the covered product.
For purposes of this protection, “lifetime” means the reasonable usable life of the covered product and does not mean the lifetime of the purchaser.
Submitting a claim does not guarantee approval, reimbursement, repair, replacement, refund, store credit, or any other particular resolution. Claims are subject to verification, supporting evidence, product condition, carrier information, order history, product availability, and applicable law.
Approved claims may be resolved through repair, replacement with the same or a reasonably comparable item, store credit, partial refund, full refund where legally required, or another reasonable resolution determined by Amariell and permitted by applicable law.
Customers may not receive duplicate compensation for the same order, product, defect, loss, delivery issue, or incident.
Nothing in this section limits any consumer rights or remedies that cannot legally be excluded or restricted.
8. Sizing and Customer Responsibility
Customers are responsible for reviewing product details, sizing information, and order selections before completing a purchase.
Sizing guides and recommendations are provided for general informational purposes only and do not guarantee fit. Amariell is not responsible for customer errors in selecting size, variant, shipping address, billing details, or other order information.
9. Promotions, Discounts, and Free Offers
From time to time, Amariell may offer promotions, discount codes, free shipping offers, gifts, or limited-time offers.
Unless otherwise stated, promotions:
- cannot be combined
- have no cash value
- may be modified or withdrawn at any time

We reserve the right to cancel or refuse promotions where misuse, abuse, fraud, technical error, or violation of offer terms is suspected.

Amariell disclaims warranties relating solely to website availability, website performance, uninterrupted access, third-party services, and online content to the fullest extent permitted by applicable law.
Nothing in these Terms disclaims, restricts, or overrides:
any express written warranty provided by Amariell
any approved Lifetime Order & Shipping Protection coverage
any implied warranty that cannot legally be disclaimed
any non-waivable consumer protection right
any obligation expressly stated in our posted policies
No employee, contractor, fulfillment partner, influencer, affiliate, or other third party may create an additional warranty or guarantee on behalf of Amariell unless expressly authorized by Amariell in writing.
15. Limitation of Liability
To the fullest extent permitted by law, Amariell and its owners, officers, employees, contractors, affiliates, service providers, fulfillment partners, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to the use of, or inability to use, the website, products, or services.
This includes, without limitation, damages relating to delays, lost profits, lost savings, lost opportunities, data loss, business interruption, chargeback disputes, carrier delays, customs issues, stolen packages after delivery confirmation, or unauthorized access.
To the fullest extent permitted by law, if Amariell is found liable for any claim, our total liability shall not exceed the amount paid by the customer for the specific product giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, willful injury, violation of law, or any other liability that cannot legally be excluded or limited.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Amariell and its owners, affiliates, officers, employees, contractors, service providers, and representatives from third-party claims, damages, liabilities, losses, costs, or reasonable legal expenses arising directly from:
your unlawful or fraudulent use of the website
your intentional violation of these Terms
your infringement of another person’s intellectual property or legal rights
your submission of unlawful, fraudulent, or intentionally misleading content or information
This indemnification obligation does not apply to claims, losses, or liabilities caused by Amariell’s own breach, negligence, fraud, willful misconduct, or violation of law.
Nothing in this section limits any rights or protections that cannot legally be waived or restricted.

18. Chargebacks, Payment Disputes, and Duplicate Recovery
If you experience an issue with an order, you agree to contact Amariell at support@amariell.com and provide us with a reasonable opportunity to investigate and respond before initiating a chargeback or payment dispute, except where prohibited by applicable law.
Submitting a chargeback or payment dispute does not automatically establish that an order was unauthorized, undelivered, defective, misrepresented, or eligible for a refund.
Customers must provide truthful, complete, and accurate information to Amariell, their bank, card issuer, payment provider, carrier, and any other party reviewing the dispute.
False, misleading, abusive, duplicative, or bad-faith payment disputes may constitute a violation of these Terms of Service.
Customers may not seek or retain duplicate compensation for the same order, product, loss, defect, delivery issue, or incident. Duplicate compensation includes receiving or attempting to receive multiple refunds, replacements, credits, carrier payments, protection payments, chargeback recoveries, or other forms of reimbursement for the same claim.
If a chargeback or payment dispute is initiated while an internal claim, replacement, refund, warranty, or protection request is under review, Amariell may pause the internal resolution process where permitted by law.
If Amariell has already issued a refund, replacement, store credit, or other resolution, the customer must accurately disclose that resolution to the applicable bank, card issuer, payment provider, or reviewing party.
Amariell may provide relevant records in response to a dispute, including order information, checkout records, billing information, IP and device information where lawfully available, fraud screening results, tracking information, delivery confirmation, customer communications, policy acceptance records, claim evidence, refund records, replacement records, and promotional terms.
Amariell may restrict future purchases, refuse service, cancel pending orders, or take other lawful action when fraud, chargeback abuse, duplicate recovery, policy manipulation, or repeated unsupported claims are reasonably suspected.
Nothing in this section prevents a customer from exercising any dispute right that cannot legally be waived or restricted.
19. Governing Law
These Terms of Service and any disputes arising out of or relating to your use of the website or purchase of products shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles, except to the extent otherwise required by applicable consumer protection law.
